Whiplash injuries are a common sequela of motor vehicle collisions. Symptoms of whiplash include neck pain, back pain, headaches and pain or paresthesia in the upper extremities. A less common, but often more life altering result of whiplash is mild traumatic brain injury (MTBI). MTBI may also be referred to as closed head injury or post concussion syndrome. Trauma sustained in motor vehicle collisions (MVCs) is the single most common cause of both fatal and mild brain injuries, causing 67% of all cases.
The mechanism of MTBI is thought to be the stretching or shearing of axons. An axonis a long, slender projection of a nerve cell, or neuron, that conducts electrical impulses away from the neuron’s cell body. This injury involves damage to individual neurons and loss of connections among neurons which can lead to a breakdown of overall communication among neurons in the brain. In motor vehicle crashes, axonal shearing is the result of excessive forces generated by the rapid change in direction of the head secondary to vehicle acceleration upon impact.
MTBI and post concussion syndrome are often associated with direct trauma to the head. This, however, is not necessarily the case in motor vehicle collisions. The unique forces generated in these collisions are sufficient to injure brain cells in the absence of direct trauma. Collision speeds of 7-10 mph are sufficient to cause symptoms of MTBI. In fact, cognitive and emotional deficits from MTBI may be more prevalent in less severe injuries than those with greater trauma and more prolonged loss of consciousness.
Symptoms of MTBI include headaches, dizziness, nausea, ringing in the ears and blurred vision. Emotional symptoms may include irritability, anxiety, depression and sleep disturbances. A typical chronology of this syndrome is that of relatively few symptoms at the time of hospital or emergency room discharge. Symptoms increase in frequency up to 90 days post trauma. Thereafter, many symptoms tend to improve with time. Headaches, dizziness and cognitive problems tend to persist for longer periods and may lead to chronic disability.
Since standard diagnostic tools such as MRI and CT are not helpful in diagnosing MTBI, it must be diagnosed via a multi-faceted clinical approach. Open ended questions about symptoms following a motor vehicle collision also result in the under reporting of symptoms due to confusion on the part of the patient as to the varied nature of their complaints. Physician intake forms should have a checklist of the more common symptoms associated with MTBI. If multiple symptoms are checked the clinician should suspect MTBI. The next clinical step is to differentiate pre and post injury symptoms. A good tool for this is the Rivermead Post Concussion Questionnaire.
The Rivermead test consists of two sections. The first section (RPQ-3) consists of three items (headaches, feelings of dizziness and nausea) and the second section (RPQ-13) contains items including sleep disturbance, fatigue and poor concentration. The total score for RPQ-3 items is potentially 0-12 and is associated with early clusters of MTBI symptoms. If there is a higher score on the RPQ-3, earlier reassessment and closer monitoring is recommended. The RPQ-13 score is potentially 0-52, where higher scores reflect greater severity of MTBI symptoms. The RPQ-13 items are associated with a later cluster of symptoms, although the RPQ-3 symptoms of headaches, dizziness and nausea may also be present. The later cluster of symptoms is associated with having a greater impact on participation, psychosocial functioning and lifestyle. The Rivermead test should be repeated at 60-90 day intervals. Persistent high scores warrant further testing by a neuropsychologist.
Neuropsychological evaluation for MTBI consists of a battery of questionnaires and tests designed to describe and quantify changes in cognition, personality, emotional functioning, behavior and to monitor functioning over time.
Due to the subjective nature of many of the complaints attributed to MTBI, the issue of malingering is often associated with these cases. Clinicians must be aware of this and properly document any inconsistencies with patient history, activities of daily living and reports from family members. The many social and emotional issues that accompany a motor vehicle collision must also be factored into the diagnostic equation. The frustration of dealing with police reports, insurance claims and lost work often exacerbate MTBI symptoms.

Bicyclist and Their Rights to the Roadway
As an attorney, I have handled multiple claims for bicyclists. Several of these claims have involved the same set of circumstances. A bicyclist is riding his bicycle down the street in the bike lane, as they are required to do. Then out of nowhere either a careless passenger from a vehicle double-parked and blocking the bicycle lane exits or the driver after he has legally parked exits his vehicle. Neither one looks and the bicyclist smashes into a door head on. All of the cases I have handled like the above have involved a serious injury, including a displaced fracture, which left a permanent injury. These are horrible personal injuries that occur because a driver was simply careless.
In several of the cases, the reporting traffic officer found my clients at fault through his own faulty logic, sloppy reporting and a lack of knowledge of the rules of the road. If that is the case for you or someone you know, it can always be fixed and argued around.
In most jurisdictions, such as California, police reports are not admissible into evidence. As a matter of fact, police reports are generally inadmissible. There are multiple hearsay problems with the report. Generally, the officer is making a legal conclusion. Legal conclusions are up to the fact-finder, meaning the judge or the jury.
The insurance company will try to argue the opposite with you but they are generally wrong when it comes to this.
In one police report I dealt with where a bicyclist was doored due to a van double parking in a bike lane, the officer’s line of thinking went like this: 1) Bicycles must follow the rules of the road, just as a driver of a motor vehicle must [Cal. Vehicle Code § 21200(a)]; generally, a vehicle must not pass another vehicle on the right [Cal. Vehicle Code § 21754]; the bicycle is a vehicle, and he was passing on the right. Therefore, the bicyclist is at fault. What?!
Not only is this incorrect. It is contradictory and does not take into account several other laws. First bicycle lanes are on the right side of the road. If a motor vehicle suddenly pulls into the bicycle lane, as they sometimes tend to, the bicyclist is stuck. The cyclist has only a few options at that point. One is to hit the back of the vehicle, which then the officer may attempt to still put them at fault for following too closely, stating that the cyclist was in violation of California Vehicle Code § 21703. Another option, if there is time to do so, is to exit the bike lane and attempt to pass on the left, which still could result in being doored by the driver or being struck by traffic on the cyclist’s left. The final option is to pass on the right in the lane that belongs to bicyclists to begin with.
Many officers neglect to take the following code section into account, California Vehicle Code Sec. 21209 reads as follows, (a) No person shall drive a motor vehicle in a bicycle lane established on a roadway pursuant to Section 21207 except as follows: (1) To park where parking is permitted; (2) To enter or leave the roadway, (3) To prepare for a turn within a distance of 200 feet from the intersection.
Additionally, some cities, like San Francisco, created a vehicle ordinance more strict than the above code section. San Francisco Vehicle Ordinance Sec. 38. N reads as follows, no person shall park any vehicle such that any portion of the vehicle is within a marked bicycle lane. No person shall block any portion of a marked bicycle lane with his or her vehicle on weekdays from the hours of 7:00 a.m. to 9:00 a.m. and from 4:00 p.m. to 6:00 p.m. Any person violating this Section shall be subject to a fine of $100. The Department of Parking and Traffic may install signs or otherwise alert motorists of this prohibition and the fine.
If a vehicle does violate the above codes, they are negligent per say. They are in violation of a code that was clearly enacted in order to protect bicyclists from the type of injury caused by these actions.
Bike lanes are on the right side of the road. You cannot be said to be passing a vehicle when the vehicle stops directly in your bicycle lane. If you are the victim of such an accident or the incorrect conclusion is drawn by an officer, do not take it. Background: The Requirement of a Driver’s License for a “Motor Vehicle”
The statutory provisions governing driver’s licenses in Florida are contained in Chapter 322. Under Section 322.03, “a person may not drive any motor vehicle upon a highway in this state unless such person has a valid driver’s license…” Under 322.34, a person who drives a motor vehicle upon a highway while his or her driver’s license has been canceled, suspended, or revoked, commits either a moving violation or a criminal traffic offense, depending on whether the person knew of their suspended or revoked status.
What is a “Motor Vehicle” for Purposes of Chapter 322, Florida Statutes?
The definition of “motor vehicle” for offenses committed under Chapter 322 is contained in Section 322.01(27), Florida Statutes. It provides as follows:
“[A]ny self-propelled vehicle, including a motor vehicle combination, not operated upon rails or guideway, excluding vehicles moved solely by human power, motorized wheelchairs, and motorized bicycles as defined in [Section] 316.003.”
Although the statute refers to Section 316.003 as the definition of “motorized bicycle,” in actuality Section 316.003 merely defines the term “bicycle” and contains within that definition a description of “motorized bicycle.” However, Florida courts have universally interpreted this description as the operative definition of “motorized bicycle” for purposes of the licensing requirements of Chapter 322. Section 316.003(2) provides as follows:
“[E]very vehicle propelled solely by human power, and every motorized bicycle propelled by a combination of human power and an electric helper motor capable of propelling the vehicle at a speed of not more than 20 miles per hour on level ground… having two tandem wheels, and including any device generally recognized as a bicycle though equipped with two front or two rear wheels.”
Thus, unless the vehicle in question is propelled by a combination of human power and an electric helper motor, and unless that vehicle travels at speeds not in excess of twenty miles per hour on level ground, the vehicle does not qualify as a “motorized bicycle.” If the vehicle does not qualify as a motorized bicycle within the meaning of the statute, then it requires a valid Florida driver’s license, even it resembles what would commonly be thought of as a motorized bicycle.
Florida Case Law: “Mopeds”
Florida courts have specifically addressed the requirement of driver’s license in the context of a so-called “moped” operated on public highway. In State v. Meister, 849 So. 2d 1127 (Fla. 4th DCA 2003), the defendant was charged under Section 322.34 for driving on a suspended license while operating a moped. The moped in question had a displacement of less than 50 cc, did not exceed two horsepower, and had pedals to permit propulsion by human power so as to supplement the gasoline engine. The defendant moved to dismiss the charges, arguing that the “moped” was not a motor vehicle for purposes of Section 316.003(21), Florida Statutes.
On appeal, the Florida Fourth District Court of Appeal held that a moped was a “motor vehicle” for purposes of charges brought under Chapter 322. Using the definition of motor vehicle contained in Section 322.01(27), the court concluded that a moped was a self-propelled vehicle and was in no way excluded from the definition of motor vehicle for purposes of the Florida driver’s license statute. Thus, regardless of how the term moped was defined for purposes of Chapter 316 (pertaining to traffic control), the operative definition for driver’s license requirements was that contained in Section 322.01. The Court furthermore rejected the argument that the differing definition of “motor vehicle” in Chapter 316 rendered Section 322.34 unconstitutionally vague or ambiguous.

As well, you must be able to show the vehicle has had the specified number of repair attempts mandated by your state during the first 18,000 miles or two years of service.
